Informal resolution first

If we cannot resolve a dispute informally, you and Doggone Good Heating and Cooling agree that the dispute will be resolved by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable consumer rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration will take place in or near East Baton Rouge Parish, Louisiana, or by remote/virtual means where available. This agreement is governed by the Federal Arbitration Act.

Class-action waiver

You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

30-day right to opt out

Opting out will not affect any other part of these Terms.

Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any written service agreement, constitute the entire agreement between you and us regarding the website and supersede any prior understandings on that subject.
